Toxicological tests showed a Yuba City man's blood alcohol content was 0.16 when the personal watercraft he was on struck and killed a toddler at a Feather River Beach, an official said today.
The victim of the Aug. 16 accident at Mosquito Beach was 3-year-old Dominique Lee Williams of Marysville.
The 0.16 level is twice the legal limit for driving a car.
Allan John Minkema, 50, will face two felony charges — vessel manslaughter and causing bodily injury by driving under the influence — when he is arraigned Sept. 29 in Sutter County Superior Court, said Assistant District Attorney Fred Schroeder.
The other man on the Polaris watercraft had no alcohol in his system. John William Blanchard, 63, originally was arrested on the same charge as Minkema but the case against him now is "in limbo." The investigation continues, said Schroeder.
A few days after the accident, a Sutter County Sheriff's Department official said Minkema and Blanchard both had their hands on the handlebars of the craft when it hit the toddler.
If convicted, Minkema faces a maximum four years in prison on the manslaughter charge and three years maximum on the DUI charge. He cannot be convicted of both, said Schroeder.
Minkema and Blanchard are free on $50,000 bail each. Both are due in court Sept. 29.

OMG. This is very sad news. I have a 4 yr old and stuff like this makes me sick to my stomach.

Throw the book at the drunk guy!
However, how much you want to bet that the non-drunk guy had his hand on the bars to try to avoid the accident?

I have a problem with the wording. It seems like the author wants us to believe that the poor drunk man was merely along for the ride when his evil PWC decided to kill. If you take notice you find similar wording in article regarding SUV accidents also. Not to sound too conspiratorial but it is part of a concerted effort to paint our craft as evil because of a few bad idiot like this one.
