How to Fight Speed ticket in no Wake zone ? !
I just got first ticket on the water
Nothing much $90. I did wakes in no wake zone, was going 5-6 miles.
cop told me I did wakes. I cannot image how I cannot do wakes in rough water riding on jetski. Waves are everywhere.
100% I wanna go to the court. Don't want to support the war!
My question is to law knowledgeable members of society how to fight it right. What exactly to say to the honorable ?
Fighting speed tickets is essential just like know how to change oil.

If you go to court with the reasoning that you were doing the speed you considered safe in rough conditions, taking with you the weather report from the day and maybe pictures of the area with similar conditions. Then hope the water cop doesn't show up because it is your word against his and thats not good unless the judge has skis.

Basic rule of maritime law
You may want to pull some legal language out of the maritime
There is a basic principal that the Captain of a vessel, ie you, must
operate it in a safe manner. That includes going fast enough to
maintain steerage. If you have a 5 knot current coming at you then
you must run say 10 knots of speed through water which is really
5 knots over bottom.
What angle of sight was he in relation to you? That has a lot
to do with perception of speed. Did he have a radar gun?
I hate those mofo's in Miami. I spent many years boating when
I lived on Rivo Alto island on the Venetian causeway. I don't think I saw
a water cop from one year to the next and that was the cocaine
I rarely jetski anywhere in Palm Beach, Broward or Dade counties these
days. The police presence, the rules, the no signs but you gotta know
'em anyways regs, etc. have taken all the pleasure out of it for me.

tell them you had to have that speed to maintain safety, handleing and as mirror said. Do a video at idle in rough water (Idle) then one in calm

That's right - you were going just fast enough to maintain control of your craft... Ron

ive gotten out of those tickets before, i get the 50 foot rule crap thrown at me all the time saying i wasnt at idle speed within 50 feet of anything.
my argument has always been, "you tell me which wave is 50 feet from the bank!" we usually argue about the distance and i'll go bust out the 100 foot tape and run it out and ask him where i was exactly when he saw me giving it gas.
if you get a real dickhead then theres no use argueing. of course your situation is a little different being you made a wake in a no wake, tell him you were about out of gas and were revving it up a little in hopes to make it back to the bank? or it was fixing to die and your battery was dead and you didnt want to be stranded on the water? or you had diarreah and were going to haul ass until you saw him looking at you?

Make the cop show you his certificate to operate radar equiptment... I have beat that kind of b/s before... take it to court with the book about the laws and safe water operations and get the water cop to show you in the book about how accurate he is at detecting speed hwile both of you are moving .... lmfao .. wish i could se the face on the judge when you ask that question... They won't have any choice but to throw it out .. where is the evidence of you speeding ??? How can the cop figure out if your making the wake or is it the roughness of the water??? must be one eagle eyed mfer
